ACG BRIEFING:
ASSET RECOVERY ACTION PLAN HOME OFFICE CONSULTATION

In May 2007, the Home Office issued a consultation on the Government's Asset Recovery Action Plan proposals for new powers to build on their efforts in the recovery of criminal assets, in the context of the changes introduced to enforcement of the Proceeds of Crime Act 2002 by the Serious Crime Act 2007.

For us, the most important of those changes was the transfer of powers to trace and seize assets under POCA from the Assets Recovery Agency to the Serious Organised Crime Agency, in April 2008.

In this consultation, the Government was seeking stakeholder views on proposals for new powers to build on existing efforts in the recovery of criminal assets.

The consultation was aimed at those with an interest in the recovery of criminal assets and criminal justice. In addition to the Alliance response (link on previous page) to which ACG contributed, LACORS also responded.

The usual post-consultation government response is still awaited, the consultation having closed last November.

Of particular importance to TS is the
review of the incentivisation schemean opportunity to lobby for an increased share for prosecutors and investigators, which both the Alliance and LACORS have highlighted.
